Terms of Sale

These terms apply to everything you buy on members.dan-ford.com. Please read them before you buy. By completing a purchase you agree to them.

These terms apply to purchases made by consumers. If you are buying as a business, contact us at info@dan-ford.com and we will agree separate terms.

1. About us

Level Group Ltd is the seller. We are registered in England and Wales under company number 05538601, with our registered office at 3 Warwick House, Wells Road, Malvern, England, WR14 4RP.

Level Group Ltd is not registered for VAT. No VAT is charged and the price you see is the total you pay.

Coaching sessions bought here are delivered by Dan Ford of Dan Ford Coaching Ltd on our behalf, and are booked through dan-ford.com.

2. What we sell

Platform memberships. These renew automatically until you cancel.

• Fathom: £25 a month or £250 a year
• Career Designer: £25 a month or £250 a year
• All Access: £35 a month or £350 a year, covering both platforms and any platform we add to the membership while you are a member

Coaching subscriptions. These are fixed terms, paid once at the start.

• 3 months, with 3 coaching sessions and All Access for the term: £495
• 6 months, with 6 coaching sessions and All Access for the term: £895
• 12 months, with 12 coaching sessions and All Access for the term: £1,650

Session packages sold at dan-ford.com are a separate purchase from Dan Ford Coaching Ltd, under its own terms.

3. Your contract with us

Your contract starts when we email you to confirm your purchase. That email contains these terms and your cancellation rights.

You must be 18 or over to buy.

4. Access to the platforms

Your access is tied to the email address you pay with. Sign in to each platform with that address. To change it, contact us.

Access continues while your membership is paid, or for the length of your coaching term.

We aim to keep the platforms available at all times but cannot guarantee uninterrupted access. We may change or remove features. If we remove a platform from All Access altogether, you may cancel and we will refund the unused part of what you have paid.

5. Coaching sessions

Sessions last 60 minutes and are held by video or phone.

Your sessions are available across the whole term rather than released month by month. Use them before the term ends. Any sessions left at the end of the term expire, and are not refunded or transferred.

Book, reschedule and cancel sessions through your account on dan-ford.com, against the times available. You can reschedule at any point before a session starts. A session you do not attend, and have not rescheduled, counts as used.

Coaching is a professional service. We do not guarantee any particular outcome. It is not therapy, or medical, legal or financial advice.

6. Cancelling a platform membership

Starting straight away. Platform access is digital content. The law says we must not start supplying it during the 14-day cancellation period unless you expressly ask us to and accept that your right to cancel will end once we do. We ask for that at checkout, so that you can use the platform immediately.

14-day money-back promise. On top of that, we give you our own promise:

• Cancel within 14 days of your original purchase and we refund what you paid in full. Access ends when the refund is made.
• The 14 days run from your original purchase, not from a later renewal.
• After 14 days, cancel at any time. Your membership stops renewing and access continues to the end of the period you have paid for. No refund for part of a period.

To cancel, reply to your confirmation email or contact us at info@dan-ford.com.

Refunds are made within 14 days of us receiving your cancellation request, to the payment method you used.

7. Cancelling a coaching subscription

You have 14 days from the date of payment to cancel. Tell us by replying to your confirmation email or by contacting us at info@dan-ford.com. You do not have to give a reason.

By buying, you ask us to start supplying straight away, which means your platform access opens and you can book sessions immediately. If you then cancel within the 14 days, we refund what you have paid less a proportionate amount for what has already been supplied. That amount is:

• the value of any session already held, calculated as the price of your term divided by the number of sessions it includes, and
• the value of platform access for the days used, calculated at £35 a month.

If nothing has been supplied, you receive a full refund. Refunds are made within 14 days of us receiving your cancellation, using the same payment method.

After the 14 days, your term runs as agreed. We do not refund unused sessions or the remaining part of a term.

The 30-day money-back guarantee offered on session packages at dan-ford.com does not apply here.

8. When a coaching term ends

Your coaching ends. When your term ends, All Access ends with it. You can start a membership at any time.

Everything you have built in the platforms stays yours and remains available while you hold a membership.

9. Prices and payment

Prices are in pounds sterling and are the total payable.

Payment is taken by Stripe. We do not store your card details.

We may change the price of a membership. We will tell you at least 30 days beforehand, and the new price applies from your next renewal. You can cancel before it takes effect.

If a payment fails we will try again. If it continues to fail, your access ends.

10. Your content, and ours

What you put into the platforms is yours. We do not claim ownership of it.

While you are a member you have a personal licence to use the platforms. You may not copy, resell, redistribute or sub-licence the platforms, their frameworks or their content, or use them to build a competing product.

11. Your data

Level Group Ltd is the data controller for your purchase. We handle personal data as set out in our privacy policy: https://members.dan-ford.com/privacy

12. If something goes wrong

Under the Consumer Rights Act 2015, digital content must be of satisfactory quality, fit for purpose and as described, and services must be carried out with reasonable care and skill. Nothing in these terms affects those rights.

To complain, email info@dan-ford.com. We will reply within five working days.

13. Our liability

We do not exclude or limit our liability where the law does not allow it, including liability for death or personal injury caused by our negligence, and for fraud.

Subject to that, our total liability to you for any claim is limited to the amount you have paid us in the 12 months before the claim.

14. Ending your access

We may end your access if you break these terms, misuse the platforms or do not pay. If we end your access for any other reason, we will refund the unused part of what you have paid.

15. Changes to these terms

We may update these terms. The terms that apply to your purchase are the ones published when you bought. If a change materially affects an ongoing membership, we will email you at least 30 days beforehand and you may cancel if you do not accept it.

16. Law

These terms are governed by the law of England and Wales. If you live in Scotland or Northern Ireland, you may bring proceedings in your own courts.
